| Fact Founds:
Sea state- 13-14 knots of wind, 2-3 feet of chop, current less than 1 knot, Etchell fleet
Vulcan on starboard tack approaching zone, Minute on port tack, Comet on close hauled course
windward and astern of Vulcan
Within zone, Minute tacked onto starboard
Vulcan and Minute were 1-3 feet apart
Vulcan (who was fetching the mark) sail above a close-hauled course to avoid. Contact was made
between Comet’s bow and Vulcan’s starboard aft corner.
Conclusion:
After Minute passed head to wind from port to starboard tack inside the zone and was then fetching
the mark, she caused Vulcan, on starboard tack since entering the zone, to sail above close-hauled to
avoid contact. Minute broke RRS 18.3.
It was not reasonably possible for Vulcan the right-of-way boat to avoid contact with Comet when it
was clear that Minute was not keeping clear. Vulcan did not break RRS 14
Since Vulcan sailing within the mark-room to which she was entitled and the contact did not cause
damage or injury, she is exonerated under RRS 43.1(c) for breaking RRS 14.
Rules applicable: 18.3 14, 43.1(a)
Decision: Minute (Sail number 1305) is disqualified from race 7 |
